Applicability, Language of the Contract<\/b><\/li>\n<\/ul>\n<span style=\"font-weight: 400;\">(1) The following Terms and Conditions (T&#038;C) apply to all contracts you enter into with us, QN Europe Deutschland GmbH, Neuhofstra\u00dfe 9, 64625 Bensheim, Germany, Commercial Register Number HRB 94131, through this online store.<\/span>\n\n<span style=\"font-weight: 400;\">(2) The only language available for the conclusion of the contract is German. Translations of these Terms and Conditions into other languages are provided for informational purposes only. In the event of any discrepancies between the German text and the translations, the German text shall prevail.  <\/span>\n\n<span style=\"font-weight: 400;\">(3) The customer is a consumer to the extent that the purpose of the ordered goods and services cannot be attributed predominantly to the customer\u2019s commercial or self-employed professional activity. By contrast, a business entity is any natural or legal person or partnership with legal capacity that, at the time the contract is concluded, is acting in the course of its commercial or self-employed professional activity. <\/span>\n<ul>\n \t<li><b>  2 Applicable Law, Mandatory Consumer Protection Provisions<\/b><\/li>\n<\/ul>\n<span style=\"font-weight: 400;\">The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods, if<\/span>\n\n<span style=\"font-weight: 400;\">(a) You have your habitual residence in Germany, or<\/span>\n\n<span style=\"font-weight: 400;\">(b) Your habitual residence is in a country that is not a member of the European Union.<\/span>\n\n<span style=\"font-weight: 400;\">If you have your habitual residence in a member state of the European Union, German law shall also apply, provided that this does not affect any mandatory provisions of the country in which you have your habitual residence.<\/span>\n<ul>\n \t<li><b>  3 Formation of the Contract<\/b><\/li>\n<\/ul>\n<span style=\"font-weight: 400;\">(1) The presentation of products and services in our online store does not constitute a legally binding offer, but rather an invitation to place orders (invitatio ad offerendum).<\/span>\n\n<span style=\"font-weight: 400;\">(2) By clicking the &#8220;Buy Now&#8221; button in the final step of the ordering process, you are submitting a binding offer to purchase the goods displayed in the order summary and\/or to book the services listed in the order summary. We will then immediately send you an automatic confirmation of receipt via email, which lists your order again and which you can print using the \u201cPrint\u201d function. The automatic confirmation of receipt merely documents that we have received your order and does not yet constitute acceptance of the offer. The contract is not concluded until we issue a declaration of acceptance, which is sent in a separate email (order confirmation). In this email or in a separate email\u2014but no later than upon delivery of the goods\u2014we will send you the contractual agreement (consisting of the order, Terms and Conditions, and order confirmation) on a durable medium (email or paper printout) (contract confirmation).      <\/span>\n<ul>\n \t<li><b>  4 Technical Steps for Finalizing the Contract and Correcting Data Entry Errors<\/b><\/li>\n<\/ul>\n<span style=\"font-weight: 400;\">To place an order, first add the desired goods and\/or services to your shopping cart. There, you can change the quantity at any time or remove goods and services entirely. Once you have added items and services to your shopping cart, click the &#8220;Continue&#8221; button to proceed to a page where you can enter your information and select your shipping and payment methods. On the summary page that opens, you can review your entries. To correct input errors (e.g., regarding the payment method, your information, or the quantity), click \u201cEdit\u201d next to the respective field. To cancel the order process, simply close your browser window. By clicking the \u201cBuy Now\u201d confirmation button, your declaration becomes binding in accordance with Section 3(2) of these Terms and Conditions. However, your declaration can only be submitted and transmitted if you accept these Terms and Conditions by checking the \u201cAccept Terms and Conditions\u201d box.        <\/span>\n<ul>\n \t<li><b>  5 Storage of the Contract Text<\/b><\/li>\n<\/ul>\n<span style=\"font-weight: 400;\">You will receive the terms of the contract, as well as information about the goods ordered and\/or services booked\u2014including these Terms and Conditions and information about the right of withdrawal\u2014via email upon acceptance of the contract offer or upon notification thereof. The contractual agreement will be stored in compliance with data protection regulations. <\/span>\n<ul>\n \t<li><b>  6 Opening a Customer Account<\/b><\/li>\n<\/ul>\n<span style=\"font-weight: 400;\">Once you have created a customer account, you can order goods or services from our online store. With a customer account, you do not have to enter your personal information every time you use our online store; instead, you can log in to your account with your email address and password before or during the ordering process. Simply by registering, you are under no obligation to purchase any of the products we offer.    <\/span>\n<ul>\n \t<li><b>  7 Terms of Payment<\/b><\/li>\n<\/ul>\n<span style=\"font-weight: 400;\">(1) Currently, customers can pay via PayPal, credit card, or bank transfer.  <\/span>\n\n<i><span style=\"font-weight: 400;\">-PayPal<\/span><\/i>\n\n<span style=\"font-weight: 400;\">If you select PayPal as your payment method, you will be redirected to PayPal after completing your order. There, you can log in to your PayPal account or create a new PayPal account and authorize the payment. If the due date for payment is determined by the calendar, the customer is in default as soon as the date passes. In this case, the customer must pay late payment interest for the year at a rate of 5 percentage points above the base interest rate.  <\/span>\n\n<span style=\"font-weight: 400;\">(3) The customer\u2019s obligation to pay late-payment interest does not preclude us from claiming additional damages resulting from the delay.<\/span>\n<ul>\n \t<li><b>  8 Retention of Title<\/b><\/li>\n<\/ul>\n<span style=\"font-weight: 400;\">The goods remain our property until full payment has been made.<\/span>\n<ul>\n \t<li><b>  9 Delivery, Availability of Goods, Prices, Shipping Costs<\/b><\/li>\n<\/ul>\n<span style=\"font-weight: 400;\">(1) The delivery times we specify are calculated from the date of our order confirmation, subject to prior payment of the purchase price. The delivery time for the respective merchandise is listed in our online store. <\/span>\n\n<span style=\"font-weight: 400;\">(2) If the product selected by the customer is unavailable at the time the customer places the order, we will inform the customer of this immediately in the order confirmation. If the product is permanently unavailable, we will refrain from issuing a declaration of acceptance. In this case, no contract is formed.  <\/span>\n\n<span style=\"font-weight: 400;\">(3) If the product specified by the customer in the order is only temporarily unavailable, we will also inform the customer of this immediately in the order confirmation.<\/span>\n\n<span style=\"font-weight: 400;\">(4) Shipping costs are listed in the product description and will be billed separately.<\/span>\n\n<span style=\"font-weight: 400;\">(5) All prices listed on our website include the applicable statutory value-added tax.<\/span>\n<ul>\n \t<li><b>  10 Right of Withdrawal<\/b><\/li>\n<\/ul>\n<span style=\"font-weight: 400;\">As a consumer, you have the right to cancel in accordance with the following provisions. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their self-employed professional activity. <\/span>\n\n<b>CANCELLATION POLICY<\/b>\n\n<b>RIGHT OF WITHDRAWAL<\/b>\n\n<b>You have the right to cancel this contract within 14 days without giving any reason.<\/b>\n\n<b>The cancellation period is fourteen days from the day on which you, or a third party designated by you (other than the carrier), took possession of the goods.<\/b>\n\n<b>To exercise your right of withdrawal, you must notify us, QN Europe Deutschland GmbH, Neuhofstra\u00dfe 9, 64625 Bensheim, Germany, email: eu.support@qneurope.com, phone: +49 (0)6251 98 91 640, of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by mail, fax, or email). You may use the attached model withdrawal form for this purpose, although this is not required.   <\/b>\n\n<b>To comply with the cancellation period, it is sufficient to send the notice of your intention to exercise your right of cancellation before the cancellation period expires.  <\/b>\n\n<b>CONSEQUENCES OF WITHDRAWAL<\/b>\n\n<b>If you withdraw from this contract, we must refund to you all payments we have received from you, including delivery costs (except for any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery option we offer), without delay and no later than fourteen days from the day on which we receive notice of your withdrawal from this contract. We will use the same payment method for this refund that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees in connection with this refund.   <\/b>\n\n<b>We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever comes first.  <\/b>\n\n<b>You must return or hand over the goods to us without delay and, in any case, no later than fourteen days from the date on which you notify us of your withdrawal from this contract. The deadline is met if you ship the goods before the fourteen-day period expires. You are responsible for the direct costs of returning the goods. Claims arising from defects that we have fraudulently concealed are subject to the standard statute of limitations. <\/span>\n\n<span style=\"font-weight: 400;\">(3) You are also entitled to rights arising from defects under a warranty of quality and\/or durability, provided that we have expressly granted such a warranty with respect to the item sold in the specific case.<\/span>\n<ul>\n \t<li><b>  12 Limitation of Liability<\/b><\/li>\n<\/ul>\n<span style=\"font-weight: 400;\">We are liable for willful misconduct and gross negligence. Furthermore, we are liable for the negligent breach of obligations whose fulfillment is essential for the proper performance of the contract, whose breach jeopardizes the achievement of the contract\u2019s purpose, and on whose compliance you, as a customer, may reasonably rely. In the latter case, however, we are liable only for foreseeable damages typical for this type of contract. The same applies to breaches of duty by our agents.   <\/span>\n\n<span style=\"font-weight: 400;\">The above disclaimers of liability do not apply in cases of injury to life, body, or health.
